Terms of Service

These Terms of Service ("Terms") govern access to and use of All Day (the "Service"), provided by All Day ("All Day," "we," "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the business you represent ("Customer").

1. The Service

All Day is a task management and accountability platform for restaurants and similar hospitality businesses, including task assignment, photo-verified task completion, bilingual (English/Spanish) content, and related reporting features.

2. Accounts

An account must be created by someone authorized to act on behalf of the Customer. Customer is responsible for the accuracy of information provided and for activity that occurs under its organization's account, including accounts of individual crew members it invites.

3. Subscription & Billing

The Service is billed on a per-seat, monthly subscription basis, currently $1 per active seat per month, processed through Stripe. By subscribing, Customer authorizes recurring monthly charges to the payment method on file until the subscription is canceled. 4. Acceptable Use

Customer agrees not to use the Service to store or transmit unlawful content, to attempt to disrupt or gain unauthorized access to the Service, or to use the Service in a way that violates the rights of others.

5. Customer Data

Customer retains ownership of the task, photo, and organizational data it submits to the Service ("Customer Data"). We process Customer Data to provide the Service, as described in our Privacy Policy. Customer is responsible for ensuring it has the right to submit any data (including photographs of employees) that it uploads.

6. Termination

Either party may terminate an account by canceling the subscription. We may suspend or terminate access for a material breach of these Terms, including non-payment, that is not cured within a reasonable time after notice.

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by law, All Day will not be liable for any indirect, incidental, or consequential damages arising from use of the Service, and our total liability for any claim will not exceed the amount paid by Customer for the Service in the three months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after a change constitutes acceptance of the updated Terms.
